House of Timeshare - Terms of Use

User Conduct
1. The user shall use the website for lawful purposes only. User shall not post or transmit through this website any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, indecent or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without House of Timeshare' express prior approval, contains advertising or any solicitation with respect to services. Any conduct by a member that in House of Timeshare' discretion restricts or inhibits any other member from using or enjoying the website will not be permitted, and may result in revocation of membership without issuing a refund.

2. A Member may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part. The user may download copyrighted material for the user's personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, publication or commercial exploitation of downloaded material will be permitted without the express permission of House of Timeshare and the copyrighted owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark, legend or copyright notice shall be made.

3. The User shall not upload, post or otherwise make available on the website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the User. The User may upload public domain materials and is responsible for and assumes all risks with respect to the determination of whether materials uploaded are in the public domain. User shall be solely liable for any damages resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such submission. User hereby grants House of Timeshare, the right to copy, publish, and distribute any material made available on House of Timeshare by the user, including but not limited to any material posted by the user on the website's pages and any email queries submitted by the User to House of Timeshare.

Monitoring
House of Timeshare shall have the right, but not the obligation, to monitor the content of this website, including pages, and messages to determine compliance with this Agreement and any operating rules established by House of Timeshare.  House of Timeshare shall have the right in its sole discretion to refuse to post or remove any material submitted to or posted on this website. Without limiting the foregoing, House of Timeshare shall have the right to remove any material that it finds to be in violation of the provisions hereof or otherwise objectionable, and the additional right to deny any User who fails to conform to any provision of this User's Agreement access to this website. Removal or refusal to post materials submitted will be at the sole discretion of House of Timeshare.

House of Timeshare neither confirms nor regularly edits any member information and does not check into the background of the persons supplying information.  However, House of Timeshare does attempt to the best of its abilities to confirm the accuracy of information provided. It is the sole responsibility of any person viewing or relying on information found at this Internet site to verify the accuracy of any information contained therein. House of Timeshare suggests that all potential renters or their agents confirm all the terms of the proposed transaction (or other accommodations agreement) in writing in advance of the transaction. House of Timeshare cannot and does not control whether or not a member completes a timeshare rental. House of Timeshare does not take responsibility for, nor can it guarantee the success or failure of timeshare rentals (or other accommodations agreements) that result from the use of this system.

Limitation of Liability
Your use of the House of Timeshare web site and its contents is at your own risk. If House of Timeshare is unable to provide the promised level of service for any reason, including, but not limited to, negligence, service outages, acts of God, neither House of Timeshare, nor any individual associated with House of Timeshare can be held liable for any costs beyond the actual cost paid by the client for their services (listing cost). Neither House of Timeshare nor any of its affiliates or parties involved in creating or delivering the House of Timeshare web site will be liable for any compensatory, direct, indirect, special, incidental or consequential damages, loss of data, income or profit, loss of or damage to property, or any claims of third parties arising from use of the site, regardless of the legal theory on which the claim is based, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of this information.

Applicable Law
The House of Timeshare web site is controlled by House of Timeshare, a Corporation of the State of Oklahoma with its office within that state. The Internet site can be accessed throughout the United States and other countries and any of these locations can have laws which may differ from those of the State of Oklahoma. By accessing the House of Timeshare web-site both you and House of Timeshare, LLC agree that the laws and statutes of the State of Oklahoma will apply to all matters or disputes stemming from the use of this site, its contents and materials. You and House of Timeshare further agree to submit to the exclusive personal jurisdiction and venue of the Superior Court of Oklahoma, Oklahoma County, and/or the United States District Court to any matters relating to the use of the House of Timeshare web-site and its contents or any transaction arising from such use.

House of Timeshare reserves the right to change the aforementioned terms at any time by reported changes online and will therefore be affective immediately. 

Changing Terms
House of Timeshare shall have the right at any time to change or modify the terms and conditions applicable to the Users use of this website or any part thereof, and to impose new conditions.

Such changes, modifications, additions, or deletions shall be effective immediately upon posting on the website or by any means of notification by which User obtains actual knowledge thereof. Any use of the Online Services by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications, additions or deletions.

As stated above, by accessing this website, the User is deemed to have agreed to comply with all of the aforementioned terms and conditions of House of Timeshare.
